Summertime lemonade for sale!

The selling of lemonade on the streets of New York can be traced back to when a Big Apple child sold the sweet concoction to thirsty streetcar riders over 130 years ago.

As lemonade stands have long been a symbol of youthful segues into the business world, they are typically exempt from permitting requirements; however, in 2015, a Texas child was forced to close their lemonade stand and told their kitchen would need to be inspected.

Resulting from that case, in 2018, Country Time, a mainstay in the childhood lemonade stand world, created Legal-Ade, which pays up to $300 of the legal fees for lemonade stands fined for permits.

In 2019, bill S762 was introduced into the New York State Legislature that would “exempt lemonade stands operated by persons under 16 years of age from Department of Health permitting requirements.”

Former State Sen. Phil Boyle (R-4th District) was a co-sponsor of the bill.

As of print, the bill is still pending a vote while the Senate’s health committee examines the legislation.
